We are committed to protecting privacy, and accordingly, we do not collect personally identifying information unless it is provided voluntarily and knowingly, and do not share any information with anyone outside of our Company other than described herein. We do not sell, rent or pass on personally identifiable information to any third party other than as necessary to provide the Services unless we have your consent or as otherwise set forth herein. All third parties that require such information to provide the Services will agree to use any such information based on our instructions and in compliance with this Privacy Policy.

The Company may share the fact that you have a Rainy Day account in good standing with any organization with which the Company has executed a non-disclosure agreement.  This may allow the Company to help you obtain access to other products and services for which you have applied such as a mortgage, credit card or bank account.

    3. Under circumstances such as loan default, the Company does share information with credit agencies and other financial firms related to credit defaults, and with those persons who referred you to Rainy Day to report that the loan was repaid on time or when the loan repayment is delayed or defaulted since these situations would have a positive or negative impact on their account.

    4. The Company may provide such information to third parties without your consent if it reasonably believe that access, use, preservation or disclosure of such information is necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce the terms applicable for use of the Services, including investigation of potential violations, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or our safety or the safety of our users or the public as required or permitted by law.

     

  6. SUBMISSION OF OTHERS' PERSONAL INFORMATION

     
    1. From time to time we may ask you to provide personal details of friends or business associates so that the Company can send them details of the Services. Before providing such information, please insure you have obtained their consent. The Company will use any such information only in a manner that is compatible with this Privacy Policy.

We use best-in-class cloud based web and data hosting services to store your data.  Any transmission of data, such as filling out the online application, is done through using an encryption method such as secure socket layer (SSL) and authentication to protect the loss, misuse and alteration of your personal information under our control. Registered accounts are secured by your created username and password, and we take precautions to insure that account information is kept private. We use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our representatives and technical staff.

    2. Please note that we cannot fully guarantee the security of account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information at any time.

    3. Electronic communications, including emails are not necessarily secure when they are transmitted. If your communication is sensitive or includes highly confidential information, you may want to provide it through a secure connection to our website, by post or via the telephone instead. The Company does not regularly collect credit card information but should it be necessary to provide credit card details those should only be submitted through a secure connection to our website.

     

  8. BANK INFORMATION

     
    1. With respect to your banking information, this information is sent encrypted to a secure server only for disbursement and payment processing. The information is then used solely to complete your transaction.

     

  9. COOKIES AND WEB BEACONS

     
    1. Like many companies, we use "cookie" and/or "web beacon" technology. Cookies may give us such information as your log in details and when you have accessed the Services before. Web Beacons are tags that can monitor the behavior of a user accessing the Services.

    2. Cookies are used during your connection with the Services to allow you free access to the Services and to use the Services without repeatedly requiring you to re-enter your user name and password. The cookies do not provide us with any way to contact you.
